By engaging our services, you agree to be bound by the terms set out in this agreement, including any service confirmations, written or verbal communications, and any invoices or documentation we provide.

Please read these Terms carefully before submitting a request, as they govern the rights and responsibilities of both parties in relation to each sourcing engagement.

2. Scope of services

Under this sourcing agreement, FOMO Call offers the following services:

Global sourcing of luxury items, including fashion, accessories, watches, and lifestyle products.
Access to rare, sold-out, or exclusive items not available through standard retail channels.
White-glove service for handling requests, logistics, and special packaging.
Personalized communication to ensure your expectations and preferences are fully met.

3. Turnaround time

The typical sourcing period ranges from 3–14 business days, depending on item availability, rarity, and geographic location.
Once sourcing is confirmed, express shipping via DHL or UPS (or equivalent) generally takes 1–5 business days.s some text inside of a div block.

All timelines are estimates and may be affected by factors outside our reasonable control, including customs processing, carrier delays, or supplier availability.
Real-time updates will be provided throughout the sourcing process for transparency.

4. Order acceptance & confirmation

Sourcing begins only after:

Written confirmation of your request.
Receipt of the agreed deposit payment.

Each request is binding and may include non-refundable fees due to time-sensitive procurement and handling.
Pricing and availability are subject to change based on market conditions. If changes occur, we will notify you promptly before proceeding.
Customers are responsible for ensuring the accuracy of item specifications, shipping details, and payment information.

5. Payment

For purchases under €10,000, we accept:

Stripe
Revolut Payment Links
Bank Transfers

In certain cases, purchases may be made in the client’s name. In such cases, we may request specific personal information to be provided to the store to complete the purchase.

6. Purchasing products via third parties

When we source items from third-party retailers:

We act on your behalf in accordance with your request.
Your personal and delivery information may be shared with third parties solely for fulfilling the order, under our Privacy Policy and applicable data protection laws.
Retailers may have their own terms, delivery times, and return/refund policies.
Prices may not include import taxes or duties. These are your responsibility unless otherwise stated.

7. Delivery & risk transfer

FOMO Call arranges insured, express shipping via DHL, UPS, or equivalent.

Risk of loss and title pass to you upon confirmed delivery at the address you provide.Damage claims must be reported within 48 hours of delivery by email to info@fomocall.com. Claims after this window may not be accepted.

8. Product descriptions & visual representation

While we strive to provide accurate product descriptions and images, please note:

Information may come from third-party suppliers and cannot be guaranteed to be error-free.

9. Authenticity & ownership

FOMO Call guarantees that all sourced items are:

100% genuine and authentic.
Sourced from authorized retailers, brand boutiques, or verified private sellers.
Free from liens, encumbrances, or claims.
In full compliance with applicable laws and ethical standards. We do not deal in counterfeit or unauthorized copies.

10. Confidentiality

We treat all client data, sourcing details, and communication with the strictest confidentiality.
We do not share your information with third parties without your explicit consent, unless required by law or regulatory authority.
Internal access to sensitive data is limited to personnel involved in fulfilling your request and is handled in accordance with appropriate data protection measures and GDPR standards.

11. Cancellation & modifications

Once sourcing has begun, cancellations are generally not accepted.
In certain cases and at our discretion, cancellations may be approved.
If sourcing is unsuccessful, your deposit will be refunded or credited toward a future request.

12. Our Right to decline or cancel requests

We reserve the right to:

Decline any request that violates ethical standards or legal obligations.
Cancel or withdraw offers or services due to reasons including ineligibility, legal limitations, or market conditions.
End our contract with you if you breach these terms or fail to make due payment.

13. Import Duties & Customer Responsibilities

You are responsible for all applicable customs duties, import taxes, or local fees.
FOMO Call is not liable for any delays or costs due to customs processing.
It is your responsibility to provide accurate item, shipping, and payment information.

14. Missing, damaged, or faulty products

Items may be vintage or pre-owned and may show signs of previous wear.
If items are missing or faulty on delivery, contact us immediately.
Faulty products may be returned for a refund, repair, or replacement.
This does not apply to damage from misuse, neglect, or general wear and tear.
We may request the return of faulty items for inspection.

Your consumer rights remain unaffected.

15. Our Responsibility for Loss or Damage

We are liable only for foreseeable losses resulting from our failure to meet these terms.
We are not responsible for:

Loss or damage that was unforeseeable.
Loss not caused by our breach.
Business-related or commercial losses.

Nothing in these terms excludes liability for death, personal injury, or fraud caused by our negligence.

16. Events outside our control (Force Majeure)

FOMO Call is not liable for any delays or failures caused by events beyond our control, including but not limited to:

Natural disasters, pandemics, strikes, wars, transport/logistics failures, or governmental actions. If affected, we will notify you promptly and take reasonable steps to minimize disruption.

17. Amendments to Terms

FOMO Call reserves the right to update these Terms & Conditions at any time.Changes will be communicated via our official channels and will apply to all future sourcing requests.

18. Governing Law & Jurisdiction

This agreement is governed by Danish law.
Any disputes will be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark.
